Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and DailyApple LLP, a limited liability partnership registered in Mumbai, Maharashtra, India ("DailyApple LLP", "we", "us", or "our"), governing your access to and use of Hire A Clanker, our adaptive GMAT preparation platform (the "Service"). By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and enter into these Terms, consistent with the Indian Contract Act, 1872. If you are a minor, a parent or legal guardian must accept these Terms on your behalf and supervise your use of the Service. You represent that all registration information you provide is accurate and that you will keep it up to date.
2. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized use of your account. Accounts are for individual, personal use — you may not share your login with another person or use the Service on behalf of multiple test-takers under one account.
3. The Service
Hire A Clanker provides GMAT Focus Edition preparation tools, including an adaptive diagnostic, a question bank with worked explanations, full-length mock exams, an AI tutor, spaced-repetition review, and a study plan. GMAT® and GMAT Focus Edition® are trademarks of the Graduate Management Admission Council™ (GMAC), which does not endorse, and is not affiliated with, Hire A Clanker or DailyApple LLP.
4. Plans, payment, and refunds
Free trial. New accounts include a 7-day free trial of every Pro feature. No payment method is required to start it, and it does not convert into a paid plan on its own.
Paid plans. Pro is sold as a one-time payment for a fixed window of access — not a subscription. Nothing auto-renews, no payment method is stored, and your access simply ends when the window does. Current plans are $249 for 3 months, $399 for 6 months, and $599 for 12 months, in US dollars. Prices may change, but a change never affects a plan you have already purchased.
Payment processing. Payments are processed by Razorpay, our payment processor. Your card details are provided directly to Razorpay and are never seen or stored by us; we receive only the order and payment identifiers, the plan purchased, the amount, and whether the payment succeeded. See our Privacy Policy for what we do with that data.
Refunds. Every paid plan carries an unconditional refund: email [email protected] within 7 days of your payment, for any reason, and we refund it in full. Refunds are returned to the original payment method — typically within 5–7 business days, though international cards can take up to 20 business days — and we cannot process a refund more than 6 months after the payment. This refund is separate from, and in addition to, the Score Improvement Guarantee in Section 7.
Active development. The Service is under active development: features, content, and availability may change, and the Service may experience downtime or bugs without notice.
Communications. You may receive occasional emails from us about your preparation and your account (for example, a welcome note, a check-in as your exam approaches, or a request for feedback), in addition to any study reminders you opt into. You can opt out of these founder emails at any time using the unsubscribe link in any such email; account and security notices necessary to operate the Service may still be sent.
5. Acceptable use
You agree not to:
- Use the Service to cheat during an actual, proctored GMAT exam or any other academic assessment;
- Copy, resell, sublicense, rent, or share access to the question bank, explanations, or AI tutor outputs with anyone outside your own account;
- Scrape, reverse-engineer, decompile, or otherwise attempt to extract the Service's source code, question bank, or underlying AI system prompts;
- Use automated means (bots, scripts) to access the Service, or attempt to circumvent any rate limits or usage caps;
- Upload or transmit unlawful, infringing, or abusive content through notes, bookmarks, or the AI tutor; or
- Interfere with or disrupt the integrity or performance of the Service.
We may suspend or terminate accounts that violate this section, at our reasonable discretion.
6. AI-generated content
The AI tutor and similar-question generator use third-party AI models to produce explanations and practice content. AI-generated content is provided for study assistance only, may occasionally be inaccurate, incomplete, or inconsistent with official GMAC materials, and should not be treated as authoritative. You are responsible for verifying important information against official GMAT sources before relying on it.
7. Scores and the Score Improvement Guarantee
Predicted scores are estimates. Predicted scores, section estimates, and readiness indicators shown in the Service are statistical estimates generated by our scoring engine based on your practice activity. They are not a guarantee of your performance on the official GMAT exam. Actual results depend on many factors outside our control, including your own preparation, test-day conditions, and GMAC's official scoring methodology.
The Score Improvement Guarantee. Separately from the estimates above, we offer a contractual Score Improvement Guarantee to eligible repeat test-takers who purchase a paid Pro plan (see Section 4). It applies on these terms:
- Repeat-takers only. You must have a valid official GMAT Focus Edition score from an exam taken within the last five years. First-time test-takers are not eligible for this guarantee.
- Baseline. Your baseline is that official score, which you must submit to us within 7 days of purchasing your Pro plan. Practice mocks, sectional tests, and the in-app diagnostic do not establish a baseline.
- Guaranteed target. Your target is the retake score published for your baseline's tier on our score-guarantee page. Targets rise with your baseline and never exceed a total score of 715.
- Minimum preparation window. Your official retake must be booked for a date at least eight (8) weeks after your Pro purchase date and taken while your Pro plan is active.
- Completion. Your study plan must be 100% complete before your test day, including all lessons and at least two full-length mock exams.
- Official, same-format exams. Both your baseline and your retake must be official GMAT Focus Edition administrations, and you must provide official score reports (not screenshots of unofficial estimates).
- Claim window. To claim, email your official retake score report to [email protected] within 30 days of your test date.
- Remedy. If you met every condition above and did not reach your guaranteed target, our sole obligation is to extend your Pro plan, free of charge, for a period equal to your original plan term. The remedy is a plan extension only, not a cash refund or credit. One guarantee claim per person.
- Exclusions. No-show or cancelled exams, transactions later reversed by chargeback, shared or multi-user accounts, and any violation of these Terms void the guarantee.
- Relationship to the refund. This guarantee is in addition to the unconditional 7-day money-back refund that accompanies each paid plan and does not limit it.
8. Intellectual property
The Service, including its question bank, explanations, software, design, and branding (including the Hire A Clanker name and marks), is owned by DailyApple LLP or its licensors and is protected by applicable intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial GMAT preparation. All rights not expressly granted are reserved.
You retain ownership of notes and other content you submit through the Service. By submitting it, you grant us a license to store, process, and display it back to you as part of operating the Service.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY CONTENT (INCLUDING AI-GENERATED CONTENT) IS COMPLETELY ACCURATE. THIS IS PARTICULARLY TRUE WHILE THE SERVICE REMAINS UNDER ACTIVE DEVELOPMENT (SECTION 4).
10. Limitation of liability
To the maximum extent permitted by applicable law, DailyApple LLP and its officers, partners, and personnel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the total amount, if any, that you paid us for the Service in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify and hold DailyApple LLP harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service or your violation of these Terms, except to the extent caused by our own willful misconduct.
12. Termination
You may stop using the Service and request deletion of your account at any time by contacting us. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms or if required by law. Sections that by their nature should survive termination (including Sections 8 through 11 and 14) will survive.
13. Changes to the Service or these Terms
We may modify or discontinue features of the Service, and may update these Terms, at any time, particularly as the Service evolves. We will post the revised Terms here with an updated "Last updated" date and, for material changes, provide additional notice where reasonably practicable. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing law and dispute resolution
These Terms are governed by the laws of India, without regard to conflict-of-law principles. If a dispute arises, you agree to first contact us at [email protected] so we can attempt to resolve it informally within 30 days. Any dispute not resolved informally will be referred to and finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator mutually appointed by the parties (or, failing agreement, appointed in accordance with that Act). The seat and venue of arbitration will be Mumbai, Maharashtra, India, and the proceedings will be conducted in English. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in the courts of competent jurisdiction at Mumbai, which will have exclusive jurisdiction over matters not subject to arbitration.
15. Grievance Officer
In accordance with the Information Technology Act, 2000 and the rules made thereunder, the Grievance Officer for Hire A Clanker can be reached at [email protected]. We will acknowledge grievances within 24 hours of receipt and endeavor to resolve them within 15 days.
16. General
These Terms, together with our Privacy Policy, constitute the entire agreement between you and DailyApple LLP regarding the Service and supersede any prior agreements on the subject. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision will not be a waiver of that right. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets. By using the Service, you consent to receiving communications from us electronically.
